📜 What the law says today
The CTB, in its article 181, item XX, classifies as a very serious infraction “parking in spaces reserved for people with disabilities or the elderly, without the credential proving their condition”. The current wording — which consolidated values and frameworks — was established by Law No. 13,281/2016, which updated the Code’s fines and punishments.

The CTB is of 1997, but the rules and values in force for reserved spaces have undergone adjustment of penalties Law 13.281/2016. Since then, parking in these spaces without a credential is very serious (R$ 293.47 + 7 points).
🪪 Who is eligible and how the credential works
The space marked with the International Symbol of Access (wheelchair) must be used by vehicles transporting people with disabilities (physical, visual, intellectual, ASD, etc.) or reduced mobility, identified by the credential. The spaces with the elderly symbol are reserved for people with 60 years or older, also with credentials.
The credential is issued by city hall (municipal transit authority). The process is usually simple:
- Check your city hall's website for the “PcD/Elderly Parking Credential” service 🌐.

⚖️ What about the new project that increases the fine?
The Chamber of Deputies is currently processing the Bill No. 4767/2024, which proposes substantially increase the amount of the fine for those who unduly occupy reserved spaces. The text, presented in 2024, suggests triple the current value (going to something in the region of R$ 880) and, in case of recidivism, apply an even greater penalty (above R$ 1.460). In 2025, the PL follows under discussion in the Chamber's committees. Until eventual approval and sanction, the CTB rules already explained above apply.

- Safety First: avoid confrontation. If you decide to approach, remain respectful and ask for credential 🙏.
- Record the irregularity: Write down the license plate, location, date, and time. Photos help—as long as they don't expose vulnerable people 📷.
- Call the inspection: in public areas, call the municipal guard, CET/local transit authority or use your city's reporting channel ☎️.
- Private establishments: shopping malls, markets, and hospitals must also monitor. Look for administration of the place 🏬.
